Welcome to Monday Hires. These Terms of Service (“Terms”) govern your use of our website at mondayhires.com and the recruitment services we provide. By accessing our website or engaging our services, you agree to be bound by these Terms. If you do not agree, please do not use our services.

1. About Our Services

Monday Hires is an overseas recruitment service operated by AgencyHires Pty Ltd in partnership with Art of Mondays. We connect businesses and founders with pre-vetted, top-tier global talent for full-time, dedicated roles. Our services include candidate sourcing, vetting, shortlisting, interview coordination, and onboarding support.

2. Eligibility

You must be at least 18 years of age and have the legal capacity to enter into a binding agreement to use our services. By engaging with Monday Hires, you represent and warrant that you meet these eligibility requirements and that you are authorized to act on behalf of any company or entity you represent.

3. Service Engagement

Our recruitment process begins with a free consultation and search. You are under no obligation to hire any candidate we present. Fees are only payable once you confirm a hire through Monday Hires. The specific terms of each engagement, including fees, timelines, and scope, will be outlined in a separate service agreement or proposal provided to you before any charges apply.

4. Fees and Payment

Monday Hires operates on a transparent pricing model. Full details of our pricing are available on our website. Key points include:

  • There is no cost to search. You only pay when you hire a candidate through our service.
  • Monthly talent rates are all-inclusive, covering salary, benefits, equipment allowance, and ongoing support.
  • No long-term contracts are required. You may cancel with 30 days' written notice.
  • Payment terms and methods will be outlined in your service agreement.

5. Replacement Guarantee

If a hire placed through Monday Hires does not work out, we offer a free replacement guarantee. The specific terms and timeframe of this guarantee will be detailed in your service agreement. This guarantee applies only to placements made directly through our service and is subject to the conditions outlined in your agreement.

6. Client Responsibilities

You agree to:

  • Provide accurate and complete information about your hiring requirements, company, and role specifications.
  • Treat all candidates with respect and professionalism throughout the recruitment process.
  • Not directly contact, hire, or engage any candidate introduced by Monday Hires outside of our service without our prior written consent.
  • Make timely payments in accordance with the agreed terms.

7. Candidate Information and Confidentiality

All candidate profiles, resumes, assessments, and related information shared with you during the recruitment process are confidential and proprietary to Monday Hires. You agree not to share, distribute, or disclose candidate information to any third party without our prior written consent. Candidate information is provided solely for the purpose of evaluating potential hires through our service.

8. Non-Circumvention

You agree not to circumvent Monday Hires by directly hiring or engaging any candidate introduced to you through our service for a period of 12 months from the date of introduction, unless a placement fee has been paid to Monday Hires. This applies regardless of whether the candidate is hired for the originally discussed role or a different position.

9. Intellectual Property

All content on the Monday Hires website, including but not limited to text, graphics, logos, images, and software, is the property of Monday Hires or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on our website without our prior written permission.

10. Website Use

When using our website, you agree not to:

  • Use the website for any unlawful or fraudulent purpose.
  • Attempt to gain unauthorized access to any part of the website, its servers, or any connected systems.
  • Introduce any viruses, malware, or other harmful material.
  • Scrape, crawl, or use automated means to collect data from the website without our express permission.

11. Limitation of Liability

To the fullest extent permitted by law, Monday Hires shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of our services or website. Our total liability for any claim arising from our services shall not exceed the fees paid by you to Monday Hires in the 12 months preceding the claim.

While we take great care in vetting and presenting candidates, we do not guarantee the performance, conduct, or suitability of any candidate placed through our service. The hiring decision and ongoing employment relationship remain your responsibility.

12. Disclaimer of Warranties

Our website and services are provided on an “as is” and “as available” basis. We make no warranties or representations, express or implied, regarding the accuracy, completeness, or reliability of any information on our website or the suitability of any candidate. We disclaim all warranties to the fullest extent permitted by law.

13. Indemnification

You agree to indemnify, defend, and hold harmless Monday Hires, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of our services, your breach of these Terms, or your violation of any applicable law.

14. Termination

Either party may terminate the service relationship at any time with 30 days' written notice, subject to the terms of any active service agreement. We reserve the right to suspend or terminate your access to our website or services immediately if you breach these Terms. Provisions relating to confidentiality, non-circumvention, intellectual property, limitation of liability, and indemnification shall survive termination.

15. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of Australia. Any disputes arising from these Terms or your use of our services shall be resolved through good-faith negotiation. If a resolution cannot be reached, disputes shall be submitted to the courts of Australia, and you consent to the jurisdiction of those courts.

16. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated “Last Updated” date. Your continued use of our website or services following any changes constitutes acceptance of the revised Terms. We encourage you to review this page periodically.

17. Severability
